Woman reports posting of nude photographs

A Bismarck woman told police her ex-boyfriend posted nude photographs of her online without her permission, but police say that’s not illegal.

Bismarck Police Lt. Steve Scheuer said the 20-year-old woman reported that she learned through Facebook that her 24-year-old ex-boyfriend had posted photographs of her on a website that allows people to post explicit photographs of their former partners. The woman told police she did not give permission for the photographs to be posted.

However, Scheuer said posting such photographs is not illegal in North Dakota unless the person in the photographs was younger than 18 or the photographs were taken without the knowledge of their subject.

Such postings, often referred to as “revenge porn,” have been outlawed in California and New Jersey, and numerous states have considered prohibitions on them, according to the National Conference of State Legislatures. The North Dakota Legislature has not considered such a ban.
