South Central District Judge James Hill has dismissed the drug case against a passenger arrested and charged with another man for 30 pounds of marijuana found in a car on Wednesday on Interstate 94 in Bismarck.

Deandre Nixon, 24, of Federal Way, Wash., had been charged with felony possession of marijuana with intent to deliver in connection to the traffic stop. 

Burleigh County Assistant State's Attorney Tessa Vaagen motioned Friday to dismiss the charge as Nixon's co-defendant, Ulises Rodriguez, "has taken responsibility for all the controlled substances and paraphernalia found in the vehicle."

Hill dismissed Nixon's case on Friday.

Rodriguez is charged with felony possession of marijuana with intent to deliver and two drug-related misdemeanors in connection to the traffic stop.

North Dakota Highway Patrol said the two men were driving from Portland, Ore., to Pittsburgh, Penn.
