Police used audio recording from a woman’s cellphone to back up her allegations of rape against a Bismarck man.
Blaine Hardy, 23, was arrested Monday in connection with an incident that allegedly occurred Friday in a Bismarck apartment. Police say three minutes of audio from an encounter between the woman and Hardy was captured on her cellphone, during which she can be heard saying “no” and telling him to stop.

Hardy is charged with felony gross sexual imposition, which carries the possibility of life in prison. South Central District Judge Daniel Borgen set Hardy’s bail at $50,000 cash. He is being held in the Burleigh Morton Detention Center.
