Child sex crime case set for trial in Morton County

A Bismarck man awaiting sentencing in Burleigh County for child sex crimes pleaded not guilty to similar charges in Morton County on Monday.

Russell Walbert, 64, is charged with two counts of gross sexual imposition. He is accused of inappropriately touching a young girl in several incidents from 2001-04, according to a police affidavit. Prosecutors filed the charges in November.

South Central District Judge Daniel Borgen found probable cause to move the case forward. He scheduled a two-day trial starting May 5.

Walbert’s attorney, Kent Morrow, did not immediately return calls seeking comment.

A Burleigh County jury in November found Walbert guilty of four counts of gross sexual imposition. Authorities said he molested a different girl during incidents in 2017 in a shed at his residence and in a camper parked on his property.  He will be sentenced on March 6.
