Bar must close a week because of sex

HANKINSON (AP) - A bar where a nude couple had sex in front of other patrons will have to close for a week, the City Council has decided. Hankinson's mayor says it put his small southeastern North Dakota community in a bad light.

"We went from being an up-and-growing community to Hankinson, the place where they had sex in the bar," Mayor Joe O'Meara said. "It didn't shed a good light on our community. I'm hoping now, we can just put this past us."

Hankinson's City Council voted 7-0 Wednesday night to close the Spare Time Bar for a week and put it on probation for two years. The town of about 1,000 is south of Wahpeton, near the South Dakota border.

Graphic pictures and video of the Oct. 12 sex scene, which investigators said lasted more than half an hour, were taken by other customers in the bar and circulated on cell phones. O'Meara said some City Council got a text message on their cell phones the next morning.

Richland County prosecutors charged Joshua Fenske, 21, of Hankinson, and Adriane Diede, 21, of Breckenridge, Minn., with fornicating in public. A judge appointed a lawyer to represent them on the misdemeanor charges.

Bar owner Roger Boutain, joined by about 100 supporters, told city leaders at Wednesday night's hearing that he was not in the bar when the incident happened. He said he fired the bartender on duty at the time.

Fenske and Diede were not at the hearing. Fenske's grandfather, Harold Fenske, said he was not defending his grandson but asked the City Council to "be kind."

The suspension of the bar's liquor license is to begin Saturday. If any city ordinances are violated during probation, the city could permanently revoke the liquor license.

The Council also ordered Boutain to pay attorney fees involved in the hearing. O'Meara said they could be around $1,000.
