FARGO (AP) - Moe Gibbs, a former jailer convicted of killing Valley City State student Mindy Morgenstern, is seeking $24 million from Cass County for an injury to his right wrist, Sheriff Paul Laney says.
Gibbs has filed a notice that he wants to settle a claim for an injury he suffered in a fall at the county jail in Fargo, Laney said. The claim is not a lawsuit, he said.
"It's just a notice. He sent us a letter that basically says that he feels this happened and he would like us to settle for $24 million," the sheriff said.
"He's claiming that due to some handcuffs, that he feels he had a wrist injury that he sustained while in our custody," Laney said. "It doesn't really go into a whole lot of detail, it just says he received a wrist injury and he wants us to settle for $24 million."
Gibbs, 35, was convicted of murder last week in the September 2006 death of Morgenstern, 22, a student at Valley City State University. It was his second trial on the charge. His first, held in Minot last summer, ended in a jury deadlock.
He is scheduled to be sentenced Dec. 17. Gibbs faces a maximum penalty of life in prison without parole.
Gibbs' right wrist and arm were in a sling during the Minot trial. In Bismarck, his wrist and lower right forearm were wrapped in bandages.
Laney said he was turning the notice over to Birch Burdick, the Cass County state's attorney, and the North Dakota Insurance Reserve Fund, which provides insurance coverage to counties.
Gibbs said he was hurt May 14, while a jailer was taking him back to his cell after he had a visitor. He said he slipped on a freshly waxed floor and did not get medical attention for 22 days.
Gibbs said the injury was aggravated by handcuffs and may prevent him from ever boxing professionally again. He had boxed professionally in Washington state before moving to North Dakota.
