Man sentenced in December returned to jail

A Bismarck man has been returned to jail on probation violations and a new charge less than three weeks after being sentenced to probation for a sex offense.

Marcus Bartole was charged Friday with Class Cfelony failure to register as a sex offender. He also appeared in court Friday on a petition for revocation of probation. According to the petition filed Tuesday, he is accused of failing to register a correct address and of failing to meet with his probation officer in violation of his probation conditions.

South Central District Judge Gail Hagerty set bond for Bartole at $50,000 cash at the request of Burleigh County Assistant State's Attorney Julie Lawyer.

South Central District Judge Tom Schneider sentenced Bartole to five years with all but time served suspended on Class Bfelony sexual imposition on Dec. 23. He had spent about four months in jail on the charge. Bartole admitted to forcing a classmate to have sex when they were working on a project at her home on Oct. 22, 2007.

Lawyer said Bartole registered an address with law enforcement after being sentenced, but he never set up a meeting with his probation officer. The probation officer went to the address Bartole had registered and learned he did not actually live there, Lawyer said.

She said a probation officer previously had problems setting up appointments with Bartole to do a presentence investigation in the sexual imposition case. He eventually was put in jail, so the officer could not get the investigation completed, she said.
