Accident victim identified

An investigation continues into a pickup-pedestrian accident that killed an elderly Bismarck man Wednesday afternoon near a busy Bismarck thoroughfare.

The victim has been identified as Delmer Grabatin, 70.

No charges have been filed against the driver of the 2000 Ford pickup, Victor Richter, 79, of Menoken.

Witnesses reported the incident to 911 dispatchers shortly after 2 p.m. Wednesday.

Richter's vehicle was reportedly seen striking Grabatin at the intersection of Seventh Street and Broadway Avenue.

"He was turning left on Broadway on the very inside lane and struck him on the intersection," Bismarck Police Lt. Randy Ziegler said.

Ziegler said the accident report does not say whether the pedestrian had a signal light to walk. "We do not know if he had the right of way, but typically you yield to all pedestrians anyway."

Initial observation of the driver did not show he was under the influence of medication or alcohol. The results of blood tests are still pending.

Ziegler said Richter appeared to have no medical conditions that would have affected his judgment in driving.

Authorities said Richter did not stop, and witnesses followed the driver to Kirkwood Mall.

"As far as I know, he was not fleeing the scene, even though he did not stop. He did not know he had struck anybody. That is what he is telling us," Ziegler said.

The case remains under investigation.
