'Reverse buy' gets busts

Seven people younger than 21 have been charged with drug crimes following a "reverse buy" operation.

Burleigh County Assistant State's Attorney Lloyd Suhr said a confidential informant contacted people suspected of being involved in drug distribution and told them large quantities of marijuana and oxycodone would be available for purchase at a Bismarck hotel.

"It's a very specific targeted type of operation," he said. "We're selling to sellers basically is what it comes down to … We're not targeting people who were just using."

The informant was in a hotel room with the drugs, which had been seized from other drug operations, Suhr said. He said West Dakota SWAT members arrested suspects after transactions were completed. The Burleigh County Sheriff's Department, the Bismarck Police Department, the Metro Area Safe Trails Task Force and North Dakota Game and Fish also were involved in the reverse buy, Suhr said.

While 11 people were arrested, charges were filed against only seven of them, Suhr said. Evidence did not support charging the other four, some of whom were passengers in vehicles.

Burleigh County Assistant State's Attorney Julie Lawyer recommended cash bonds for most of the defendants in the drug cases. She said threats have been made against the confidential informant, and a brick had been thrown through the informant's father's window Tuesday morning.

The seven suspects made initial court appearances before South Central District Judge Tom Schneider on Tuesday afternoon.

n Lindsay Vivier, 19, was charged with possession of marijuana with intent to deliver, a Class Bfelony, and abuse or neglect of a child, a Class Cfelony. Suhr said Vivier showed up at the hotel room on Monday with her 15-month-old son.

Lawyer said Vivier already faces similar separate charges in another case. She is out on bond in that incident, in which she is charged with Class B felony possession of marijuana with intent to deliver, Class C felony possession of oxycodone, Class Cfelony possession of drug paraphernalia, Class A misdemeanor possession of drug paraphernalia and Class C felony endangerment of a child.

Lawyer said the child involved in that case is the same child as the case Vivier was charged in on Tuesday.

Schneider set bond for Vivier at $10,000 cash.

n Christoff Martin, 18, was charged with attempted delivery of oxycodone, a Class Afelony. Schneider set bond for Martin at $5,000 cash.

n David Perry Jr., 19, was charged with possession of marijuana with intent to deliver, a Class Bfelony. Schneider set bond for him at $5,000 cash.

n Dalton Holeman, 18, was charged with possession of marijuana with intent to deliver, a Class B felony, and conspiracy to deliver marijuana, a Class Bfelony. Erikton Holeman, 20, was charged with conspiracy to deliver marijuana, a Class B felony, and possession of drug paraphernalia, a Class Amisdemeanor. The men are brothers and are charged as co-defendants. Schneider set bond for each of them at $5,000 cash.

n Lucas Johnson, 18, was charged with delivery of marijuana within 1,000 feet of a school, a Class A felony, and delivery of marijuana, a Class Bfelony. Schneider set bond for Johnson at $5,000 cash.

n Nolan Kirkpatrick, 18, was charged with possession of drug paraphernalia, a Class A misdemeanor, and possession of marijuana, a Class Bmisdemeanor. He pleaded not guilty to both charges, and Schneider set bond for him at $500 cash.
