DUI charge based on aerosol use

An 18-year-old Bismarck man has been charged with driving under the influence after nearly striking an apartment building with his vehicle.

Caleb Seiler was charged Tuesday with the Class Bmisdemeanor for allegedly driving while under the influence of an aerosol cleaning product. Seiler is slated to make a court appearance in the case in December.

Bismarck Police Sgt. Dwight Offerman said an officer saw Seiler's vehicle, which was westbound on Century Avenue, cross the median of the divided highway, cross the eastbound lanes and drive toward an apartment building at the intersection of Century and Fourth Street.

The vehicle came close to the building but did not hit it, Offerman said. He said the only damage caused in the incident was to the grass in front of the apartment building.

The officer found an aerosol can of dust remover on the passenger seat of the vehicle. Police believe Seiler was high during the incident, Offerman said. He said a bodily fluid sample was taken for testing.
