A Bismarck man was killed in a wreck near New Salem early Sunday morning.
Dustin James Kessel, 21, was thrown from a 2001 Pontiac Grand Am driven by Jon Eikanas, 21, at 4:37 a.m. Sunday.
According to the North Dakota Highway Patrol, the vehicle was eastbound on Morton County road 139 two miles east of New Salem when it crossed the road, drove into a north ditch and struck a culvert. The car vaulted across an approach and landed facing east, the patrol said.
Kessel was pronounced dead at the scene of the crash. Eikanas, also of Bismarck, was taken to St. Alexius Medical Center and treated and released. Neither was wearing a seatbelt.
Conditions were foggy at the time of the crash, the patrol said.
Highway Patrol Capt. Eric Peterson said the accident remains under investigation, and he could not comment on whether alcohol was a factor.
Bismarck Police Sgt. Dwight Offerman said Bismarck police arrested Eikanas on Sunday at the request of his probation officer, and Eikanas was intoxicated at the time of the arrest. Eikanas is on probation for a 2006 gross sexual imposition conviction.
Burleigh County Judge Donald Jorgensen set Eikanas' bond at $25,000 for revocation of probation. Eikanas has applied for a court appointed attorney.
"There is evidence that the defendant consumed excessive amounts of alcohol," said Justin Schwarz, Burleigh County assistant state's attorney, in regard to the accident at Eikanas' preliminary bond hearing.
Eikanas denied that alcohol was a factor in the accident.
